What is Commercial Use & Copyright?

If image and video use is for the benefit of your business, i.e. Will images or video be used on your website? Will images be used for local flyers? Will images be used in a full page ad in a national magazine? Whatever the case may be, if products are used for the benefit of your business and not to hang at home, then the intended use is considered commercial.  

Except as permitted by the copyright law applicable to you, you may not reproduce or communicate any image, including downloadable files, without written permission of the copyright owner and or the purchase of a commercial license prior to image use.

What is a License?

A license is an agreement between a party and the photographer/videographer as to the usage rights that have been granted for particular image/s and video/s. It might help to think of the license as a lease and the usage rights as the terms of that lease. When images and videos are requested from a commercial client, the photographer or videographer is not selling their images or video to you, but rather, renting. The photographer/videographer may receive a payment for their time to create the images/video which covers their creative fee. However, because each commercial client is so unique and may have varying demands for images and videos, it is not possible to rely on a fixed rate creative fee to cover all these variable possibilities. Issuing a license allows you to rent images and video for the specific needs of your business.

Unless a fair trade can be made - i.e. delivering an abundance of flowers, styling services for a shoot or office, professional packaging for business, etc. - then fair compensation for commercially used content is required.
